1 - INTRODUCTION
1.1 These terms and conditions of sale (hereinafter
only "General Conditions") govern the sale of products (the "Products")
distributed by Sifar Group S.r.l. ("Sifar") through the
website www.sparepartsrealme.com (the
"Site").
The owner of the Site and the Seller is Sifar Group S.r.l. – under the
direction and coordination of its sole shareholder Esprinet S.p.A. – with
registered office at Piazza della Conciliazione 5, 20123 Milan (MI), Italy,
registered with the Companies’ Register of Milan, Monza Brianza, Lodi, Tax Code
and VAT no. 08028860966, R.E.A. MI-1999160 (“Seller”), email:
contact@sifar.it.
1.2 The purchase of Products through the Site is only
possible after registration and is available to both consumers and
professionals (the "Customers").
A “consumer” shall mean a natural person who, in connection with the purchase
of Products through the Site, acts for purposes unrelated to any business,
commercial, professional or artisanal activity they may perform. The Customer
who purchases on the Site in the capacity of a professional is not permitted to
purchase for the purpose of resale and must purchase for this purpose through
the site reserved for the B2B channel.
1.3 Access to the Site and the purchase of Products through
the Site are permitted to all Customers, regardless of their nationality, place
of residence or place of establishment, provided that they have the legal
capacity to enter into binding agreements in accordance with applicable law. By
placing a purchase order on the Site in the “e-shop” section, the Customer
declares that he/she is 18 years of age or older.
2 - CONCLUSION OF THE CONTRACT - ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE
2.1 In accordance with Legislative Decree No. 70 of April 9, 2003, containing provisions on electronic commerce, Sifar informs the Customer of the following:
- To conclude a purchase contract for one or more Products on the Site, the Customer must complete an order form in accordance with the instructions that will appear from time to time on the Site. Before submitting the order form, the Customer must carefully verify the accuracy of all data entered, as they cannot be changed once payment has been made, without prejudice to any consumer rights.
- By placing an order on the Site, the Customer declares that he/she has read all the information provided during the purchase process and fully accepts these General Conditions. The time of payment of the order depends on the chosen means of payment. Please refer to Article 4.
- The correct receipt of the order is confirmed by Sifar by sending - via e-mail - a message of acceptance of the order. Such e-mail should not be considered as acceptance of the order.
- The order is accepted through an order confirmation e-mail sent to the e-mail address provided by the Customer (the "Order Confirmation"). This confirmation e-mail will include the Order Number, to be used in all further communications with Sifar. The contract entered into between Sifar and the Customer shall be deemed concluded upon Sifar’s acceptance, even partial, of the order. Sifar reserves the right, at its sole discretion, to accept the order. In case of non-acceptance of the order, Sifar undertakes to promptly notify the Customer.
- Without prejudice to consumers’ rights and the right of withdrawal under Article 9 below, the Customer may withdraw from the contract and request cancellation of the shipment until the order is shipped by writing to the e-mail address mentioned in Article 1. The status of the order is clearly visible in the “Order Status” section the Customer’s Personal Area.
- Thereafter, Sifar will proceed to ship the purchased product at the time and in the manner indicated in these General Conditions.
2.2 The Order Confirmation contains, in addition to what is specified above, information on the main characteristics of the product purchased, details of the price, the means of payment used, delivery charges and any additional costs, information on the right of withdrawal, as well as a link to the terms and conditions applicable to the contract and a link to Sifar's Privacy Policy, which the Customer may print or save in electronic form and, in any case, keep.
3 - PRODUCT FEATURES
3.1 The Customer may purchase only those Products listed in Sifar’s electronic catalogue at the time of placing the order, which are available at www.sparepartsrealme.com, and described in the relevant product information sheets. The technical information contained in the Site accurately reproduces those provided by the manufacturers of the products listed in the catalogue. Therefore, Sifar reserves the right to modify the technical information of the Products in order to reflect any changes provided by the manufacturers, without the need for any prior notice. It is understood that the images accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics and may vary in color. Any accessory Products shown in the images are included only if specifically indicated as included in the packaging and/or price. Supplemental purchasing information (e.g., Glossary, Buying Guide, etc.) is to be considered generic and not indicative of the real characteristics of each individual product, which are detailed solely in the product information sheet.
3.2 All prices displayed on the Site are public prices and, therefore, include VAT. Sifar reserves the right to change prices at any time, without prior notice. In any case, the final price is the one indicated in the summary sheet that appears in the purchase procedure before the Customer confirms the order. In the event of an incorrect price being published, for whatever reason (e.g., system error, human error, etc.), the order may - within the limits permitted by law and without prejudice to the consumer’s rights - be cancelled, even if initially validated, with prior notice to the Customer. In the event of cancellation of an order, Sifar will request, without undue delay, through the banking systems, the reimbursement of any sums already paid.
3.3 The Site displays the Products and quantities available at the time of the order. Since the simultaneous access by multiple users and the possibility of concurrent online orders may change the availability of the product, Sifar does not guarantee the availability of ordered items. In the event that the Products are no longer available, without prejudice to the rights attributed to the Customer by law, Sifar will immediately send an email to the Customer, notifying him/her of what has happened and, as the case may be, either cancel the order, terminate the contract or propose the replacement of the unavailable product with an equivalent one. The Customer may either accept what has been proposed, cancel the order or terminate the contract if it has already been concluded. In the event that the Customer does not exercise any of these options, Sifar will cancel the order or terminate the contract. In case of cancellation of the order or termination of the contract, Sifar will request, without undue delay, through the banking systems, the release of any pre-authorized amounts, or as the case may be, the refund of the price paid. Similarly, if the alternative product proposed by Sifar and accepted by the Customer has a lower price, Sifar will request, without undue delay, the refund of the difference through the banking systems.
3.4 For certain Products, which are subject to price promotions, Sifar reserves the right to indicate the maximum number of Products that can be purchased by a Customer. Consequently, if a Customer exceeds this limit, Sifar reserves the right to accept orders by reducing their quantities, subject to prior notice and acceptance by the Customer, failing which the order shall be deemed cancelled.
4 - MEANS OF PAYMENT
4.1 For the payment of the price of the Products and the related shipping and delivery costs, the Customer may use one of the methods indicated below. Such methods may be selected by the Customer during the dedicated check-out stage.
4.2 In the case of purchases of Products by Credit Card, by entering the credit card details and following the instructions displayed on the Website, the payment is immediately processed with the simultaneous charge to the credit card, in accordance with the procedures provided by the relevant credit card issuer.
4.2.1 Credit Card
Accepted credit cards are those that rely on the Visa and Mastercard circuits.
IMPORTANT: if payment is to be made by means of a Banca Intesa Carta Moneta, it is necessary to have the Moneta Online service activated beforehand. For further details, visit www.monetaonline.it.
In case of cancellation of the order by the Customer or non-acceptance by Sifar or withdrawal from the contract or its termination, Sifar will request, without undue delay, the cancellation of the transaction and will refund any amount already paid. The time frame required for the refund depends on the banking system or credit card issuer. Once the credit order has been placed, Sifar cannot be held liable for any delays or omissions in the credit.
Sifar reserves the right to ask the Customer for additional
information (e.g., landline phone number) or to send copies of documents
proving the ownership of the Credit Card used. If the requested documentation
is not provided, Sifar reserves the right to reject the order.
At no time during the purchase process does Sifar have access to the Customer’s
credit card information, as this information is entered directly on the website
of the banking institution handling the transaction; since there is no data transmission,
there is no possibility of this data being intercepted. No computer file of Sifar
contains, nor does it store, such data. Therefore, under no circumstances can Sifar
be held liable for any fraudulent and improper use of credit cards by third
parties during payment for Products purchased on www.sparepartsrealme.com.
4.2.2 Prepaid Credit Card
In case of cancellation of the order by the Customer or non-acceptance by Sifar
or withdrawal from the contract or its termination, Sifar will request, without
undue delay, the cancellation of the transaction and will refund any amount
already paid. The time frame required for the refund depends on the banking
system or the prepaid credit card issuer. Once the credit order has been placed,
Sifar cannot be held liable for any delays or omissions in the credit.
At no time during the purchase process does Sifar have access to the Customer’s
credit card information, as this information is entered directly on the website
of the banking institution handling the transaction (with very high security
systems); since there is no data transmission, there is no possibility of this
data being intercepted. No computer file of Sifar contains, nor does it store,
such data. Therefore, under no circumstances can Sifar be held responsible for
any fraudulent and improper use of credit cards by third parties during payment
for Products purchased on www.sparepartsrealme.com.
4.2.3 PayPal
For purchases made using the PayPal payment method, the Customer will be
directed to the PayPal login page upon completion of the order. The total
amount of the order is charged to the Customer’s PayPal account at the time of
order acquisition. In the event of cancellation of the order by the Customer or
non-acceptance by Sifar or withdrawal from the contract or its termination, the
amount will be refunded to the Customer's PayPal account.
Once Sifar has requested the cancellation of the transaction, under no
circumstances may Sifar be held liable for any direct or indirect damages
caused by PayPal’s delay in not releasing the committed amount. At no time
during the purchase process is Sifar able to know the Customer’s financial
information. Since there is no data transmission, there is no possibility of
this data being intercepted. No computer file of Sifar contains, nor does it
store, such data. For each transaction performed with the PayPal account, the
Customer will receive an e-mail confirmation from PayPal.
5 - TRANSACTION SECURITY
Online Credit Card transactions are carried out directly on the Bank’s website, through a Secure Server that adopts the SSL (Secure Socket Layer) protection system. This protocol, certified by Verisign, allows communication in a manner designed to prevent interception, modification or falsification of information. Sifar has no knowledge of the details of the Credit Cards used by its customers.
6 - DELIVERY METHODS
Sifar can only accept orders for delivery within the
territory of EU. Sifar does not deliver to Mail Boxes, post offices, P.O. boxes
and to companies that provide domiciliation services. In the event that the
Customer enters such destinations, Sifar reserves the right to cancel the order
and withdraw from the contract, without prejudice to the Customer's rights. For
each order placed on the Site, Sifar shall issue, upon payment, a sales note
(equal to a receipt) or invoice for the items shipped. The fiscal document is
issued based on the information provided by the Customer at the time of the
order in accordance with the provisions of Article 2.1 a) above. After the
fiscal document has been issued, no changes will be possible.
Shipping costs are borne by the Customer and are explicitly indicated at the
time of order placement in the order summary. No additional charges or fees are
due to Sifar. Unless otherwise specified, delivery of the ordered goods is
intended to be made at roadside.
Products are shipped in packaging provided directly by the manufacturer or in
custom boxes provided by Sifar. The delivery times for the ordered goods are
purely indicative and are published in the relevant table under “indicative
delivery times”; such delivery times may be subject to changes due to force
majeure or due to traffic and general road conditions or by act of an
Authority. Standard delivery will take place during the following hours: from 9
AM to 1 PM; from 2 PM to 6 PM, on all weekdays, excluding public holidays,
Monday to Friday.
Sifar assumes no liability in the event of any delay in processing the order or
delivery of the ordered goods. Upon delivery of the goods by the courier, the
Customer is required to check that:
- the number of packages being delivered corresponds to what is indicated on the delivery note or transport document (DDT);
- the packaging is intact, undamaged, not wet or, otherwise, altered.
Any visible damage or discrepancies in the number of packages must be immediately reported to the delivering courier by marking the accompanying document with the words “withdrawal with reserve for damaged package" or "withdrawal with reserve for open package" or "withdrawal with reserve for missing packages". Additionally, the Customer is required to open a claim by filling out the appropriate “Anomalies/Refunds” section in their personal area, completing the mandatory missing fields and entering the notice “I have received a visibly damaged or tampered box” or “Some products I ordered are missing”. Once the courier's document has been signed, the Customer will not be able to make any further objection about the external conditions of the delivered goods. In case of damage not recognizable at the time of delivery as in the presence of intact packaging, the damage must be reported as soon as it is discovered and, in any case, no later than eight calendar days from receipt. In any event, this is without prejudice to the application of the rules on the right of withdrawal and the legal guarantee of conformity. Any hidden damages or anomalies must be reported in writing by registered mail with return receipt to Sifar, whose address is specified on the accompanying document. The Customer is also required to open a claim by filling out the appropriate “Anomalies/Returns” section in their personal area, completing the mandatory missing fields and entering the notice “The box is intact, but the products inside are damaged”. Any report made after the above deadlines will not be considered. The Customer assumes full responsibility for any statement made.
6.1 Delivery by express courier
Standard delivery will take place during the following hours: 9 AM to 1 PM; 2
PM to 6 PM, on all weekdays, excluding public holidays, Monday to Friday. The
courier will make the first delivery attempt without prior notice. If the
Customer is absent, the courier will leave a notice and attempt delivery again
in the next 24 hours; in case of further absence, another notice will be left,
and the shipment will be placed in storage. The Customer will be contacted by
the Sifar Care Team with whom to arrange the delivery details.
7 - ODER PROCESSING AND DELIVERY TIMES
7.1 Order processing time
"Order processing time" refers to the time interval between the
receipt of the order and the delivery of the product to the courier. All
orders, containing Products available in stock, for which payment confirmation
is received by 12 PM on a business day, will be handed over to the courier by
the evening of the same day.
7.2 Express courier delivery time
Delivery by express courier will take place within 3 to 5 working days after
receipt of payment, unless exceptional circumstances arise (natural disasters,
floods, earthquakes, strikes, sociopolitical events, etc.).
8 - DELIVERY CHARGES
8.1. Delivery charges with express courier
The cost of delivery is automatically calculated and is clearly indicated
during the order process.
9 - RIGHT OF WITHDRAWAL
9.1. In accordance with the provisions of the Consumer Code, the Customer who is a consumer and, therefore, the natural person acting for purposes unrelated to their professional activity, has the right to withdraw from the purchase contract, without providing any reason and without incurring costs other than those specified in paragraph 3 of this Article, within fourteen days from delivery, or from the day on which the Customer or a third party designated by the Customer acquires physical possession of the purchased goods. This right of withdrawal cannot be exercised in the case of purchases of products in any way customized. The conditions and procedure for exercising this right will be specified in the following paragraphs. This article does not apply to Customers-professionals.
9.2. The Customer who intends to exercise the right of
withdrawal referred to in the previous paragraph must fill out the appropriate
“Anomalies/Returns” section within its Personal Area, completing any missing
mandatory fields and specifying in the communication “I want to exercise the
right of withdrawal”. It remains, in any case, the Customer's right to
communicate by ordinary mail, registered mail, email, or fax using the
addresses and numbers indicated in Article 1, or in any case by any other form
of communication, its intention to exercise the right of withdrawal, within the
terms provided by law. Sifar’s Customer Service will process the request and
open the file in the Customer’s Personal Area. Upon receipt of the declaration
of withdrawal, Sifar will send the Customer an email confirming receipt with
the return form (RMA form) attached, provided with an authorization number,
which must be attached to the outside of the package containing the product to
be returned. To complete the withdrawal process, the Customer can access its
Personal Area and complete the procedure to request the collection of the goods
through Sifar’s trusted courier. The Customer may also choose to entrust the
goods to a different courier of their choice. In both cases, the shipping costs
for the return of the goods to Sifar will be borne by the Customer.
Upon completion of the procedure specified above, the Customer must send the
goods, carefully packed in the original manufacturer’s packaging, with the RMA
form attached to the outside, via the designated courier to the following
address: Sifar S.r.l., via 1° Maggio 37 - 20863 - Concorezzo (MB) - Italy.
In the event that the Customer decides to return the goods through a courier of
their choice, the shipment for the return of the product is the responsibility
of the Customer, until Sifar confirms receipt of the product. In the event that
the product suffers damage during the return shipping to the warehouse, it will
be the responsibility of Sifar to notify the Customer to allow them to file a
complaint against the chosen courier and obtain compensation for the value of
the goods, if insured; then, Sifar will make the product available to the
Customer, cancelling the withdrawal.
9.3. The goods to be returned must be shipped within and no later than 14 days from the date on which the Customer has notified Sifar of the decision to withdraw from the purchase contract. Sifar, in compliance with the provisions of Article 56 of Legislative Decree no. 21/2014, once it has verified compliance with the conditions set forth in paragraph 4, will refund the Customer the cost of the product within 14 days from the receipt of the withdrawal notice, without prejudice to the right to withhold the refund until the product is returned to its warehouses or until the Customer provides proof of actual shipment and delivery of the goods to the courier. Sifar is not obliged to reimburse additional costs if the Customer has chosen a delivery method other than the least expensive delivery option offered (“basic” shipping). The refund will be made using the same method used by the Customer for the purchase.
9.4. The right of withdrawal is subject to the following
mandatory conditions: The Customer may exercise the right of withdrawal solely
and exclusively with respect to the entire product; it will not be possible to
exercise withdrawal only for a part of the purchased product. The Customer is
responsible for any diminution in the value of the goods resulting from
handling the product other than what is necessary to establish its nature,
characteristics and functionality. The Customer must therefore keep and handle
the product with ordinary diligence and return it intact, complete in all its
parts, fully functional, accompanied by all relevant documentation, including
any identification tags and labels, as well as, if possible, in its original
packaging. The product must be returned in perfect condition, Products showing
signs of damage, wear or dirt will not be accepted.
In the event that the Product for which the withdrawal has been exercised has
suffered a diminution in value resulting from a handling of the good other than
what is necessary to establish its nature, characteristics and functionality,
the refund amount may be reduced by an amount corresponding to such diminution
in value, subject to prior notification to the Customer in compliance with the
terms provided by law.
9.5. The right of withdrawal shall lapse if the Customer fails to return the good to Sifar within 14 days from the date on which the withdrawal was communicated. The deadline shall be deemed to have been met if the Customer ships the goods before the expiration of the 14-day period. In all cases where the right of withdrawal lapses, Sifar will notify the Customer of the above and will return the product to the Customer who will not be entitled to any refund.
10 - WEEE
In accordance with the provisions of Legislative Decree 49/14 regarding the collection of the end-of-life electrical and electronic equipment (WEEE), in the event that the Product purchased falls within the categories envisaged by this Decree, it is possible to request the free collection of an equivalent type of equipment to the new one purchased online. Free collection is not available for purchases of Products not belonging to the EEE category. Free collection may also be refused if there is a risk of contamination for the personnel performing the collection or if it is evident that the WEEE to be collected does not contain its essential components or contains waste other than WEEE. The free WEEE collection requires the purchase of a new piece of equipment of an equivalent type and having the same functionality as the one covered by the Contract and the request must be made at the time of purchase: “one-for-one take-back”, by sending an email to Sifar at the same time as the Order is sent. Before handing over the used equipment, the Customer undertakes to take appropriate measures to effectively delete or render unintelligible any personal data contained therein.
11 - WARRANTIES
11.1 Legal Warranty
This warranty is reserved for end-customers (“End-Customers”) who make
purchases on the Site and applies to Products, including those that incorporate
or are interconnected with digital content or a digital service in such a way
that the absence of said digital content or digital service would prevent the
Products from performing their proper functions ("Products with Digital
Elements"). Unless otherwise provided by the applicable legislation in
other European countries other than Italy, all Products are covered by the
mandatory legal warranty provided by law in favor of End-Customers, pursuant to
the legislative provisions implementing Directive (EU) 2019/771 and regulated
in Italy pursuant to Articles 128 et seq. of Legislative Decree 206/2005, also
known as the Consumer Code (“Legal Warranty”). The Seller shall be liable to
End-Customers for any lack of conformity existing at the time of delivery of
the Product that becomes apparent within two (2) years after such delivery.
11.1.2 The End-Customer may request warranty service from Sifar Group S.r.l. by accessing the dedicated support section of the Site by attaching the purchase receipt or the transport document (DDT) received together with the purchased goods. The End-Customer will always be able to download the invoices/receipts related to their purchases from the Site by accessing the reserved area.
11.1.3 In the event of a lack of conformity, the
End-Customer has the right to request from the Seller, at its option and free
of charge, the repair or replacement of the Product, unless the requested
remedy is objectively impossible or excessively onerous. In such cases, the
End-Customer shall be entitled to a price reduction or termination of the
contract, at its option.
Upon verifying compliance with the above conditions, the Seller will indicate
to the End-Customer the procedures provided for the repair or replacement of
the Product under warranty. Where necessary, the Seller will arrange, at its
own expense, for the defective Product to be picked up by a courier directly to
an address indicated by the End-Customer. In such case, unless otherwise specified
by the Seller, the End-Customer shall make the Product available for
collection, complete with all its parts.
After receiving the Product, the Seller will assess the actual defect and, in
the event of a positive finding and subject to any claims by the End-Customer
as to the remedy to be pursued as per applicable law, will repair or replace
the goods at its own expense, within a reasonable time.
In case of a negative response, the Seller will promptly notify the
End-Customer of the negative outcome. In any case, the End-Customer may, at its
own expense, collect the Product from the Seller no later than 30 (thirty) days
from the communication of the negative outcome of the procedure, without
prejudice to the rights granted to the End-Customer by the relevant and
applicable legislation.
11.1.4 Except as otherwise provided for by applicable law in other European countries other than Italy, an action seeking to enforce defects not fraudulently concealed by the Seller shall be time-barred, in any event, within twenty-six (26) months after delivery of the Product.
11.1.5 In the case End-Customer informed about available updates, including security updates, necessary for the purpose of maintaining the compliance of such Products with Digital Elements (information regarding available updates, including security updates and the consequences of non-installation are provided directly by the Manufacturer through appropriate notification), and to provide them (through the Manufacturer and/or the Supplier as the case may be), in the period of time that the End-Customer can reasonably expect, given the type and purpose of the Products and Digital Elements, and taking into account the circumstances and the nature of the contract signed. If the End-Customer fails to install within a reasonable period of time the updates provided pursuant to the preceding paragraph, and provided that Seller has fulfilled its proper communication obligations, the Seller shall not be liable for any lack of conformity resulting solely from the failure to install the relevant update.
11.1.6 In the case of a customer who is not a “consumer” (“Professional Customer”) and who has therefore made the purchase on the Site for purposes related to their business, commercial, artisanal or professional activities, the provisions of the Italian Civil Code in Articles 1490 et seq. shall apply unless otherwise derogated by specific purchase conditions. The Professional Customer may always download from the site the invoices related to their purchases by accessing the reserved area.
12 - COPYRIGHT AND DATA BASE RIGHTS
All content present or made available on the Site, including but not limited to texts, graphics, logos, icon buttons, images, audio files, digital downloads, data compilations, and software, is the property of Sifar or its content providers and is protected by copyright laws and database rights laws.
13 - COMPLAINTS
Any complaint may be addressed to Sifar Group S.r.l. by mail
at Via 1° Maggio 37 - 20863 - Concorezzo (MB) - Italy, or by e-mail at contact@sifar.it.
In the event of disputes between Sifar and the Customer, who qualifies as a
consumer under applicable legislation, Sifar hereby guarantees its
participation in an amicable resolution attempt, which the Customer may
initiate through RisolviOnline, an independent and institutional service
provided by the Arbitration Chamber of the Milan Chamber of Commerce whose
website can be consulted at www.risolvionline.com. It should also be noted that
the European Commission provides a platform for alternative out-of-court
dispute resolution, which can be accessed at the website http://ec.europa.eu/odr.
It is understood that the above procedures are simply an alternative to those
provided by other legal provisions, and the Customer may still contact Sifar
via email at the address indicated above.
14 – PROCESSING OF PERSONAL DATA
Pursuant to European Regulation No. 679/2016 (the “GDPR”), Sifar Group S.r.l., as data controller, informs that the personal data acquired in connection with the purchase of Products through the website will be processed in compliance with the aforementioned regulation. In particular, pursuant to Article 13 of the GDPR, Sifar Group S.r.l. informs that the personal data provided by the Customer will be used in order to fulfill the contractual obligations arising from the sale of the products, as well as to comply with legal obligations and to enable access to and navigation of the website, to monitor its operation, and to ascertain any liability in case of unlawful acts. The provision of data is optional, but necessary for the purchase of the products. The updated privacy notice, containing all details regarding data processing, is published on the website www.sparepartsrealme.com. Customers are invited to read the privacy notice, which shall be deemed accepted in the event of Registration. The Customer may at any time exercise all the rights set out in Articles 15 et seq. of European Regulation No. 679/2016, including the rights of access, rectification, portability, updating, objection, restriction of processing, as well as erasure. All the aforementioned rights may be exercised by writing to privacy@sifar.it.
15 - JURISDICTION AND APPLICABLE LAW
The sales contract between the Customer and Sifar is
concluded in Italy and governed by Italian Law. In the case of End-Customers,
any disputes arising from the interpretation or application of these conditions
or resulting from the conclusion of the sales contract at a distance, shall
fall under the jurisdiction of the court of the place of residence of the
End-Customer. In case of Professional Customer, any dispute that may arise from
the interpretation or application of these conditions or resulting from the
conclusion of the sales contract, shall fall exclusively under the jurisdiction
of the Court of Milan.
This is without prejudice to the application to End-Customers of any more
favorable and mandatory provisions of the law of the country in which they have
their habitual residence, particularly in relation to the applicable law,
warranty duration and competent jurisdiction.
16 - AMENDMENTS TO THESE GENERAL TERMS AND CONDITIONS
The General Terms and Conditions contained herein may be
amended by Sifar without prior notice and shall be valid from the date of their
publication on the website www.sparepartsrealme.com.
Pursuant to and for the purposes of Art. 1341 of the Italian Civil Code, the
Customer declares that has carefully read the above General Terms and
Conditions in all their provisions and, after careful reading, expressly
accepts all clauses, including specifically the following: Art. 6
("Delivery Methods"); Art. 7 (“Oder Processing and Delivery Times”);
Art. 8 ("Delivery Charges"); Art. 9 ("Right of
Withdrawal"); Art. 11 (“Warranties”); Art. 15 ("Jurisdiction and
Applicable Law"); Art. 16 ("Amendments to these General Terms and
Conditions").
